Acceptable Use Policy

This Acceptable Use Policy (this “AUP”) for Camp DeForest is part of the agreement that you enter into with Camp DeForest, LLC (“Camp DeForest,” “us,” “our,” “we”) when you use some of our services or products, including when you visit, use, or stay at our Camp DeForest motel, cottages, property, or facilities at 12 Whitney Road, Lincolnville, Maine 04849 (collectively, the “Property”). This AUP supplements the Terms of Use, which also is an agreement between you and us. The full agreement between you and us includes our Terms of Use, this AUP (which supplements the Terms of Use), our Reservations and Cancellations and Other Policies and Rules, and our Privacy Policy , as well as any other agreements that are accessible on our website at www.campdeforest.com or applications (the “Website”) or that we communicate with you in connection with any of our services or products, and all such other agreements are incorporated in our Terms of Use (and herein).

Scope of this AUP

If you visit or stay at our Property, you may elect to join our guest WiFi network and, in making reservations to stay with us, booking any events with us, learning about our Property, or otherwise interacting with us, you may elect to use our Website, applications, or other technologies. Thus, this AUP sets out the agreement between you and us under which you may access or use our guest WiFi network, our Website, or other applications or technologies (collectively, the “Services”). This AUP applies to all users of, and visitors to, our Services.

Your use of any of our Services means that you accept and agree to abide by all the policies in this AUP (and in our other agreements).

This Policy sets forth a non-exclusive and non-exhaustive list of activities with respect to, and uses of, our Services that we deem unacceptable. We reserve the right to modify this Policy at any time by publishing or posting a revised version of this AUP on our Website or by communicating any revisions to you. The revised version of this AUP will be effective on the earlier of (i) the date the customer or guest uses any of our Products after we publish the revised version on our website; or (ii) thirty (30) days after we publish or post the revised version on our Website.

PLEASE NOTE THAT CAMP DEFOREST CUSTOMERS AND GUESTS WHO ARE FOUND BY US TO BE ENGAGING IN ACTIVITIES PROHIBITED BY THIS AUP OR OTHERWISE IN VIOLATION OF THIS AUP OR ANY OTHER DOCUMENT COMPRISING OUR AGREEMENT WITH YOU MAY BE LIABLE FOR A SUSPENSION OF SERVICES AND ACCOUNT TERMINATION. IN CERTAIN CASES, WE MAY BE LEGALLY OBLIGATED TO REPORT SUCH CUSTOMERS, GUESTS, AND ACTIVITIES TO THE RELEVANT AUTHORITIES.

Prohibited Uses of Our Services.

Our Services may be used by you only for lawful purposes and only in compliance with (i) all our policies and agreements and (ii) all current and future applicable laws, regulations, and rules.

Thus, you agree that you will not use any of our Services, including, without limitation, our WiFi and our Website, in the following ways:

  • in any way that breaches any applicable local, national, or international law or regulation, including, but not limited to, laws against hacking, laws against extortion, consumer protection laws, and export control laws.

  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

  • for the purpose of harming or attempting to harm minors in any way.

  • to send, knowingly receive, upload, download, use or re-use any material that does not comply with our content standards (set forth below and/or in our Terms of Use, accessible on our Website).

  • to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (“spam”).

  • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

  • to send or receive any material or content (including links) that incite violence, depict a violent act, depict child pornography, depict illicit or illegal acts or events, or threaten anyone’s safety or health.

  • to send or receive any material, content, or data that is in violation of any law or regulation or that is defamatory, offensive, abusive, indecent, obscene, or in breach of confidence, privacy, trade secrets, or in violation of any third-party intellectual property rights (including violation of copyright or trademark) or in breach of any other rights of any person or entity.

To provide more detail and to be very clear about some of the above, you agree that our Services must not be used for the purpose of sending spam or any other bulk or commercial messages in violation of the laws and regulations applicable to your jurisdiction. This includes, but is not limited to soliciting customers from spam sent from other service providers and collecting replies to spam sent from other service providers.

Our Services also must not be used for the purpose of running unconfirmed mailing lists or telephone number lists (“messaging lists”). This includes, but is not limited to, subscribing email addresses or telephone numbers to any messaging list without the permission of the email address or telephone number owner, and storing any email addresses or telephone numbers subscribed in this way. All messaging lists run on or hosted by our Services must be “confirmed opt-in”. Verification of the address or telephone number owner’s express permission must be available for the lifespan of the messaging list.

We prohibit the use of email lists, telephone number lists or databases purchased from third parties intended for spam or unconfirmed messaging list purposes on our Services.

Our prohibitions stated in this AUP, including with regard to the sending of spam and similar activity, apply to messages sent using any of our Services and to messages sent from any network by you or any person on your behalf, that directly or indirectly refer the recipient to a Website, application or other Service using any of our Services.

Our Services must not be used for the purpose of advertising, transmitting, or otherwise making available any software, program, product, or service designed to violate this AUP, or the acceptable use policies of other service providers. This includes, but is not limited to, facilitating the means to send spam and the initiation of network sniffing, pinging, packet spoofing, flooding, mail-bombing, and denial-of-service attacks.

Our Services must not be used to access any account or electronic resource where the group or individual attempting to gain access does not own or is not authorized to access the resource (e.g. “hacking”, “cracking”, “phreaking”, etc.). Our Services must not be used for or to facilitate compromising or unlawful activities, including, without limitation, hacking, spamming, and accessing illegal content.

Our Services must not be used for purposely engaging in activities designed to harass another group, entity, or individual. Our definition of harassment includes, but is not limited to, denial-of-service attacks, hate-speech, advocacy of racial, religious, or ethnic intolerance, and any activity intended to threaten, abuse, infringe upon the rights of, or discriminate against any group, entity, or individual.

Our Services may not be used by any person or entity involved with or suspected of involvement in activities or causes relating to illegal gambling; terrorism; narcotics trafficking; arms trafficking or the proliferation, development, design, manufacture, production, stockpiling, or use of nuclear, chemical or biological weapons, weapons of mass destruction, or missiles; in each case including any affiliation with others whatsoever who support the above such activities or causes.

While using our WiFi, Website, or other Services, you also agree:

  • not to reproduce, duplicate, copy or re-sell any part of our Services in contravention of the provisions of our Terms of Use (available on our Website).

  • not to access without authority, interfere with, damage or disrupt:

  • any part of our Website, our WiFi, or any other Services;

  • any equipment or network on which our Website, WiFi, or other Services may be stored;

  • any software used in the provision of our Website, WiFi, or other Services or

  • any equipment or network or software owned or used by any third party;

  • any network equipment or software used to provide WiFi or network services onsite at any of our properties.

  • not to obtain (or attempt to obtain) Services from us with the intent to avoid payment.

  • not to obtain use our Services to obtain (or attempt to obtain) Services from another provider with the intent to avoid payment.

  • not to use our Services to interfere with the use of our Services or Property by other guests, customers, or authorized people or entities.

Interactive Services.

We may from time to time provide interactive Services on or through our Website or applications, including, without limitation:

  • Chat rooms.

  • Bulletin boards.

  • Blogs

  • Other Services available for communication or uploads of content.

Where we do provide any interactive Services, we will endeavor to provide clear information to you about the kind of Services offered, if it is moderated, and, if so, what form of moderation is used (including whether it is human).

It is important to us to keep our users safe. Thus, if we determine that the possible risk from third parties when they use any interactivity provided on or through our Website or other Services may warrant moderation, we may decide to provide some kind or level of moderation in light of the risks. However, we are under no obligation to oversee, monitor, or moderate any interactive Service we provide on or through our Website or any other Services, and we expressly exclude our liability for any loss or damage arising from the use of any interactive Service by a user in contravention of our content standards, whether the applicable Service is moderated or not.

Please note that the use of any of our interactive Services by a minor is subject to the consent of their parent or guardian. We advise parents who permit their children to use an interactive service that it is important that they communicate with their children about their safety online, as moderation is not foolproof. Minors who are using any interactive Service should be made aware of the potential risks to them.

Where we do moderate an interactive Service, we likely will provide you with a means of contacting the moderator, should a concern or difficulty arise.

Content Standards.

These content standards apply to any and all content or other materials that you may contribute to our Website or to or through any of our other Services (“contributions”), including any associated interactive Services of any kind.

You agree that you will comply with these content standards (both the spirit and the letter of the following standards). These content standards are supplemental to any other content standards we may set forth in our Terms of Use or in any other documents that are part of your agreement with us. Also, you agree that these content standards apply to each part of any contribution, as well as to its whole.

Contributions must:

  • be accurate (where they state facts);

  • be genuinely held (where they state opinions);

  • comply with all applicable law in the United States and/or in any country from which they are posted.

Contributions must not:

  • contain any material or content that is defamatory of any person;

  • contain any material that is obscene, offensive, hateful or inflammatory;

  • contain or promote sexually explicit material;

  • contain or promote violence;

  • promote discrimination based on race, sex, religion, nationality, ethnicity, disability, sexual orientation, or age;

  • infringe any copyright, database right, trademark, or any other right of any other person or entity;

  • be likely to deceive;

  • breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence or confidentiality;

  • contain viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;

  • promote any illegal activity;

  • be threatening, abusive, or invasive of another’s privacy, or cause annoyance, inconvenience, or needless anxiety;

  • be likely to harass, upset, embarrass, alarm, or annoy any other person;

  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person or entity;

  • give the impression that they emanate from us, if this is not the case.

  • advocate, promote, or assist any unlawful act, including, but not limited to, copyright infringement or computer misuse.

WiFi and Other Technologies – Third-Party Services. Please note that our guest WiFi network is provided by a third party, and other of our Services may be, as well. To access the WiFi network or to use some of our other Services, you may be required to consent to the third party provider's additional terms and conditions and its privacy policy; if you do not agree to those terms and conditions or privacy policy, you should not use our WiFi network or other Services that require you to agree to any terms and conditions or privacy policies that you do not agree with.

In-Room Entertainment.

While staying at Camp DeForest, you are permitted to use the provided Apple TV devices for personal entertainment purposes, including streaming content from their own accounts on compatible services, while staying at Camp DeForest. However, guests must adhere to all applicable terms of service associated with the streaming platforms and refrain from using the Apple TV for any illegal or unauthorized activities, including downloading or distributing copyrighted material without proper permission.

WiFi and Internet Services.

By connecting to the Camp DeForest Internet services (including Wi-Fi services), you (the “user”) are acknowledging you have read and understood the information contained within this Acceptable Use Policy, and agree to be bound by these terms and conditions.

The Property’s Internet service is provided as-is, without warranties of any kind, either expressed or implied. Camp DeForest does not provide technical support of any kind. Any changes to guest equipment or software are solely the responsibility of the user to ensure their system or equipment used is compatible with services offered by Camp DeForest. 

Camp DeForest does not control content made available on the Internet by third parties, however, we may block, remove, filter, or restrict access to content and systems that, at our discretion, is deemed inappropriate, violates the terms of this agreement or for any other reason. 

The user accepts responsibility for any minor children in their care using the Camp DeForest services provided to guests, including but not limited to the Internet service(s) and television. 

The user agrees not to use Camp DeForest’s Internet service(s) for any purpose that is unlawful or otherwise prohibited. The user is fully responsible for their use in accessing systems and content made available on the Internet and/or the television. 

By using our Internet service(s), the user agrees not to: (a) transmit data or materials that contain viruses and/or code designed to interrupt services, destroy, or limit the use of computer equipment, software, or telecommunications equipment; (b) transmit data or materials that infringe on the copyright, trademark or intellectual property of others; (c) transmit data or materials that are harassing, defamatory, obscene, or attacking the race, ethnicity, sexual orientation, or physical attributes of any person; (d) use equipment and services for excessive transfer of data; (e) impersonate any person, entity, or misrepresent your affiliation with any person or entity for any purpose; or (f) conduct any activities that are criminal in nature.       

Access to Camp DeForest Internet service(s) is provided as a convenience and is not intended for business use. The user agrees to hold Camp DeForest harmless for any loss of business or commerce associated with using Camp DeForest’s Internet service(s) or any failure of our network. The user agrees to release and hold harmless Camp DeForest for any direct or consequential damages suffered by the user and/or suffered to the user’s computer hardware, software, or telecommunications equipment resulting from the use or failure of Camp DeForest’s Internet service(s).

While we take every effort to respect the privacy of the user when using the Camp DeForest Internet services, we cannot guarantee privacy. During your use of the Internet services, data is collected in the form of logs for maintenance purposes, performance, and system security requirements. We will provide this information, without notification to the user, upon request by law enforcement in aiding investigation of criminal activity or civil disputes or in situations where we are acting in good faith to prevent harm to others or violations of the law. 

Disclaimer of Liability for Any Damages or Losses.

You acknowledge and agree that we are not responsible for any damages or losses that may result from your use of our guest WiFi network, our Website, or any other of our Services.

We are not liable for any undesired resource usage, or detrimental effects that may occur to your device and/or software while your device is attached to Camp DeForest’s Internet service(s). You are responsible for any actions taken from your device, whether intentional or unintentional, that damage or otherwise affect other devices or users of Camp DeForest’s Internet service(s). You hereby release Camp DeForest from liability for any loss, damage, security infringement, or injury which the user may sustain as a result of being allowed access to Camp DeForest’s Internet service(s). You agree to be solely responsible for any such loss, infringement, damage, or injury.

Suspension and Termination.

We will determine, in our discretion, whether, through your use of our guest WiFi network, Website, or any other Services, you have breached this AUP or any of our other agreements with you or any other of our other policies. If we determine that a breach has occurred, we may take such action as we deem appropriate, including the actions listed below. We reserve the right to terminate your access to our guest WiFi network, our Website, or any of our Services at any time if you do not comply with or if you engage in any activities violative of this AUP or of any of our other policies or if you are in violation of any of our agreements with you.

You acknowledge and agree that failure to comply with this AUP constitutes a material breach of our Terms of Use (available on our Website) and other agreements with you, and may result in our taking all or any of the following actions:

●      immediate, temporary, or permanent withdrawal of your right to use our Website, guest WiFi network, and/or any of our other Services;

●      immediate, temporary, or permanent removal of any posting, content, or material uploaded by you to our Website or any of our applications or interactive Services;

●      issuance of a warning to you;

●      legal proceedings instituted against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;

●      further legal action instituted against you;

●      disclosure of information about or related to your actions to law enforcement authorities as we reasonably feel is necessary.

Access to the Camp DeForest Internet service(s) may be blocked, suspended, or terminated at any time, for any reason, at our discretion, without prior notice. Any Internet service(s) advertised or represented to be available to users may be rescinded, modified, or suspended by us without notice or liability to the user.

Liability.

We will have no liability to you for actions taken in response to breaches of this AUP or our other agreements (including the Terms of Use). The responses and actions described in this policy are not limited, and we may take any other actions or responses that we reasonably deem appropriate and proper.

Changes to this AUP.

We may revise this AUP at any time by amending this AUP document. You are expected to check this document from time to time as you use our Services to take notice of any changes we make, as they are legally binding on you. Be mindful of the “Last Updated” date; it will advise of the date on which this AUP was last revised.
